BROKERAGE TERMS AND CONDITIONS

For the purpose of this agreement Marlex Marine Technolgy Ltd shall be referred to as “The Company”.

 

The Company undertake to introduce purchasers and/or sell craft on behalf of owners at a fixed commission fee of £ …………….    A charge will be awarded to the selling price if an owner privately sells his/her boat from Buckden Marina. The Marina must be advised before any private sale is negotiated.

 

Where the Vendor negotiates directly with a Purchaser, whether or not introduced by The Company, it is accepted that monies will pass through The Company and on completion of the sale, the Vendor will pay to The Company the commission payable, in accordance with paragraph 1 in the same manner as if the sale had been negotiated between The Company and the Purchaser directly.

 

Prior to accepting a vessel on Brokerage terms, The Company will inspect the craft’s suitability for sale, including test run, advising the owner of any deficiencies and approximate rectification costs, if executed by The Company.

 

All boats offered for brokerage, must be surrendered in clean and tidy condition. The Vendors will be charged for cleaning, draining or inhibiting engines or general maintenance while in the hands of The Company for sale. 

 

The Company will re-inspect all craft on brokerage on a monthly basis, reporting any deterioration, however minor, to the Vendor with estimated costs of repair if executed by The Company.

 

The Company undertake to advertise craft for sale within Buckden Marina complex and on The Company website.

 

The Company will advise the Vendor on a quarterly basis, of all interest or lack of interest in their craft for sale with a view to price discussions and reviews. All official visits and enquiries through the brokerage department will be monitored for this purpose.

 

The Company will contact the vendor with any offer made by a prospective purchaser, unless otherwise instructed e.g. below minimum offer requirement.

 

When requested to value craft for sale, The Company will advise a price based on boating industry comparisons, make, age and general condition of craft.

 

Although every care is taken of owner’s property, vessels are accepted for sale strictly at their OWNER’S RISK AND MUST BE INSURED accordingly, The Company do not hold themselves responsible for loss of contents or damage to their craft however caused.

 

 

BROKERAGE FORMS MUST BE COMPLETED IN FULL BEFORE ANY CRAFT MAY BE ACCEPTED FOR SALE

 

The Company may require that the craft are independently surveyed before they are offered for sale, such survey to be at the owner’s expense.

Any VAT rates, when applicable, will be charged.

 

The Company reserves the right to decline to offer a craft for sale at any time, without reason to the Vendor.
